Please read the following terms and conditions carefully as use
of and/or buying from the Sallis Chandler website means that you
will be bound by them.

For the purposes of these Terms & Conditions
the following definitions apply:
Contract: The
contract for sale by us and purchase of Goods by you.
Goods: The
range of plants and garden products that is available for purchase
from this site in accordance with the terms

Use of this site
The content of this site is our copyrighted
property or that of the people who have granted us the right to use
it and is protected as such. All rights reserved.
None of this material may be used without our written permission.
You may view or print single pages only for your own personal use.
Limitation of liability
This site should only be used for information
purposes. We shall not be liable for any damage or loss that may occur
in the use of any of the information contained or advice given in
this site except as stated in the terms and conditions of sale (where
applicable) and to the extent that such liability cannot be excluded
by law. We are not responsible for the sites accuracy or its
fitness for a particular purpose or the reliability of access to this
site.
We will not be liable to you or in breach of Contract for delay or
failure to perform due to any causes beyond the reasonable control
or us or our suppliers, including, but not limited to, acts of god,
civil commotion, industrial disputes, riots, flood and legislation.
Data Protection and Privacy
When you order, we need to know your name,
email address, delivery address and telephone number. This allows
us to process and fulfil your orders and to notify you in the event
of any queries. We will communicate with you by email, telephone or
letter.
We do not have access to credit/debit card details that you use to
pay for goods from our website on the Paypal site.
We do not pass on your details to anyone else without your permission
unless it is in relation to an order for goods and services through
the website (e.g. Delivery courier).
We will not sell, rent, share, trade or give away without your permission
any information we hold about you.
Changes
We reserve the right to make changes to this
web site and these terms at any time.
Basis of the sale
An agreement for us to sell you goods is made
on these terms when we accept an order made by you via our web site.
The description of the goods, the price, VAT, insurance and delivery
costs are set out on the order page.
Variation
We aim to give as clear an idea of the nature
of the plants we sell. However, you appreciate that there will inevitably
be variations in species chosen, size, shape and colour depending
on availability. Illustrations and descriptions as to individual
plant collections are intended for guidance only.
We may, at our sole discretion, from time to time, vary the nature
of the goods from that advertised, without notice, so long as these
variations are not material alterations.
Availability
The quantity, quality and description of the
goods will be those set out in your order (if accepted by us). Orders
are accepted at our sole discretion, but are normally accepted if
goods are available.
Delivery
The goods that can be ordered via our web site
are only available for delivery within mainland United Kingdom.
We will deliver the goods to the address you specify for delivery
in your order. It is important that this address is accurate. We will
not despatch a delivery of plant material without first contacting
you to check that you will be available to receive it. We cannot accept
any liability for any loss or damage to the goods once they have been
delivered in accordance with your instructions.
We aim to deliver the goods by the date quoted for delivery but delivery
times are not guaranteed. If delivery is delayed due to any cause
beyond our control, the delivery date will be extended by a reasonable
period and we will contact you to arrange an alternative time.
Risk and ownership
Risk of damage to or loss of the goods passes
to you at the time of delivery to you or, if you fail to take delivery
at the agreed time, the time when we tried to deliver.
You will only own the goods once they have been successfully delivered
and when we have received cleared payment in full.
Payment terms
Once you have sent us an order form, we will
send you an Invoice via email, showing total cost of order with a
link to pay online. Alternatively, you may pay by cheque.
No goods will be despatched until cleared payment in full has been
received. (Cheques can take 3-5 working days to clear).
Warranties
We aim to provide high quality plants and products
to our customers. We undertake that all plants will be in good condition
at the time or delivery and will be of the type ordered.
Returns Policy
We guarantee to send you top quality plants
and will inspect everything carefully before it leaves us to make
sure its in good condition. We also do our utmost to package
and protect everything so that it doesnt get damaged on its
way. However, if the goods are faulty or damaged when they arrive,
we are happy to replace or refund them free of charge.
Heres what to do:
Contact us first, either by phone or email,
to discuss how best to proceed. In some cases we may ask you to
return the goods to us, but this may not always be the case. Please
do contact us immediately (or within 7 days) as we would hope to
sort it out very quickly.
Plants
If you receive a plant that is in bad condition
when you take it out of the box, contact us immediately. We may then
ask you to send us a photo so that there is no doubt as to its condition
on arrival with you, as opposed to what it looks like by the time
you return it to us.
Please bear in mind that plants look very different depending on what
time of year it is. If you choose a nice leafy-looking deciduous shrub
in winter, remember it will arrive with no leaves on. It doesnt
mean there is anything wrong with it, just that its out of season
and will perk up when the weather does. Herbaceous perennials will
not even show above the soil level in a pot during winter but that
doesnt mean youve been given a pot of soil. However, provided
that you have contacted us within 7 days of receiving the damaged
plant we will be happy to provide a refund or replacement.
Order Cancellation
If you change your mind about anything you
order, you can cancel your order at any time. (Exclusions apply)*
Please contact us immediately because, if an item has not yet been
despatched, we will not send it out.
If items have already been despatched, they must be returned to us
in the original condition, in the original packaging.
We will not pay the costs of returning an item to us.
Until we receive the goods you are returning, they are your responsibility.
For your protection and peace of mind, we recommend you use a recorded
delivery service to return things.
If the item returned is damaged, used or not returned
in its original packaging, we reserve the right to withhold a proportion
of the refund value.
*Exclusions: Planting lists, plans and other bespoke
items ordered to customers individual specifications cannot
be cancelled once work has started on them. Please contact us directly
if you wish to cancel these items, as it may be possible to do so,
or to refund part of the original price.
General
Emails to you will be sent to the address you
specify to us. You must provide us with an accurate and valid email
address and it is your responsibility to inform us of any changes
to it.
To the extent that any provision of these terms
is found by any court or authority to be invalid, unlawful or unenforceable
in any jurisdiction, that provision will be deemed not to be a part
of these terms, it will not affect the enforceability of the remainder
of these terms, nor will it affect the validity, lawfulness or enforceability
of that provision in any other jurisdiction.
The headings in these terms are for convenience
only and will not affect their interpretation.
Statutory rights
These Terms and Conditions do not affect your
statutory rights.
